Recruitment Privacy Notice

Employment Consulting Services B.V., Fred. Roeskestraat 109, 1076 EE Amsterdam (“We”, “Us”) are the Data Controller for the personal data we collect from you during our recruitment process. We are committed to protecting and respecting your privacy and handling your data in accordance with the General Data Protection Regulation (GDPR) and all applicable Dutch data protection laws. This Privacy Notice explains how we collect, use, store, and share your personal data in connection with our recruitment activities. Please read this document carefully to understand our practices.

1. PURPOSE & LAWFUL BASIS FOR PROCESSING

We process your personal data in order to assess and select suitable candidates for our job openings. This processing is necessary for managing our recruitment process, communicating with you, and evaluating your suitability for a role within our company. More specifically, we process your personal data for the following purposes and legal basis:

Performance of a contract:

  • To manage your job application, including communicating with you, scheduling interviews, and assessing your suitability for the role.

  • To maintain records of our recruitment process and hiring decisions.

Legal obligation:

  • To comply with our legal and regulatory obligations.

Legitimate interest:

  • To analyze and improve our recruitment process and services.

Consent:

  • To communicate with you about other job opportunities that may be a good fit for you.

2. TYPES OF PERSONAL DATA WE COLLECT

We collect and process personal data that is necessary and relevant to your application. This includes data that you provide to us directly, as well as data we may collect from other sources.

Information you provide to us directly:

  • Contact and identification details: Name, email address, phone number, and address.

  • Application data: Information included in your CV, application form, cover letter, and any other documents you submit, such as your education, work experience, skills, and qualifications.

  • Interview information: Notes from interviews and any assessments you complete.

  • Right to work information: Copies of your passport, visa, or other documents to verify your legal right to work in the EU, if required at the offer stage.

  • Diversity and inclusion data: We may ask for information about your gender, ethnicity, or disability for equal opportunity monitoring. Providing this data is completely optional and will not affect your application.

Information we collect from other sources:

  • Publicly available sources: We may use Tellent Recruitee’s functionality to search for publicly available information about you on professional networking sites like LinkedIn or other public platforms to enhance the information you have provided.

  • Third-party providers: With your consent or where we have a legitimate interest, we may collect data from third-party services, such as recruiters who referred you, or from background check providers at a later stage of the process.

3. AUTOMATED DECISION-MAKING AND PROFILING

We do not use fully automated decision-making processes to make a final decision on your application.

All final hiring decisions are made by our recruitment specialists and hiring managers.

4. DISCLOSURE OF YOUR INFORMATION

We share your personal data internally with those who are directly involved in the recruitment process, such as the recruitment team, hiring managers, and relevant team members. Access is limited to what is necessary for their role in the hiring process.

We may also share your personal data with the following third parties:

  • Tellent Recruitee: As our ATS provider, they process your data on our behalf in accordance with our instructions and a Data Processing Agreement.

  • Third-party service providers: We may use other third-party services for tasks such as video interviews or skill assessments. These providers are only authorized to process your data on our behalf and must comply with our instructions and data security standards.

  • Job sites and partners: If you applied through a job board (e.g., Indeed), they may retain your data and receive updates from us about the progress of your application. Their use of your data is governed by their own privacy policy.

We do not sell your personal data to any third parties.

5. DATA STORAGE AND SECURITY

Your personal data is stored securely within Tellent Recruitee’s systems, and is processed in the EU in a GDPR-compliant manner. We have implemented appropriate technical and organizational measures to prevent your personal data from being accidentally lost, used, or accessed in an unauthorized way.

6. DATA RETENTION

We will retain your personal data for 150 days from the date of your application. 30 days before the end of the retention period, you will receive an Extension Retention email from us to ask you if you would like us to continue to store your personal data to match you with future job opportunities.

Your data will be deleted on one of the following occurrences:

  • After the retention periods have expired.

  • If you request to delete your data.

7. YOUR DATA PROTECTION RIGHTS

Under the GDPR, you have the following rights regarding your personal data:

  • Right to be informed: You have the right to be informed about how we collect and use your Personal Data.

  • Right to access: You can request a copy of the personal data we hold about you.

  • Right to rectification: You can ask us to correct any inaccurate or incomplete data we hold about you.

  • Right to erasure (the “right to be forgotten”): You can request that we delete your personal data.

  • Right to restrict processing: You can ask us to temporarily stop processing your data.

  • Right to data portability: You can request to receive your personal data in a structured, commonly used, and machine-readable format.

  • Right to object: You can object to the processing of your data based on our legitimate interests.

  • Right to withdraw consent: Where we have processed your data based on your consent, you can withdraw it at any time.

  • Right to lodge a complaint: You have the right to file a complaint with the Dutch supervisory authority if you believe we are infringing on your rights under the GDPR.
